JOHN STANTON and KELMER SMITH, JR. DEFENDANTS
COMPLAINT
COMES NOW, U. S. Sustainable Energy Corp. – NV, by and through its Chief Operating Officer, John H. Rivera, and makes this, its complaint against John Stanton and Kelmer Smith, Jr., for tortuous interference with a business contract and breach of contract and would show unto this Honorable Court as follows, to-wit:
1.
U. S. Sustainable Energy Corp. – NV, (hereinafter "USSE-NV"), is a Nevada Corporation qualified to do business in Mississippi with its principal place of business located at 110 L.E. Barry Road, Natchez, Mississippi 39120. John Stanton is a resident citizen of the State of Florida, who may be served with process at Post Office Box 24567, Tampa, Florida 33623-4567 or 6324 County Road 579, Seffner, Florida 33584. Kelmer Smith, Jr., is an adult resident citizen of Lincoln County, Mississippi who may be served with process at 2065 California Road NW, Brookhaven, Mississippi 39601.

On or about May of 2006, in Natchez, Mississippi, USSE-NV did enter into negotiations with John Stanton concerning a joint venture for the production of biofuels. As part of the negotiations, John H. Rivera (hereinafter "Rivera"), as CEO of USSE-NV, had the Defendants sign a non-disclosure and non-compete agreement due to the contract negotiations which would
reveal certain proprietary equipment and plant plans and other confidential and trade secrets and information. At all times herein complained of, the joint venture and all contracts and provisions thereof were consummated in whole or in part in Natchez, Adams County, Mississippi.

On or about May 15, 2007, John Stanton and USSE-NV thereafter came to terms, including an exchange of a certain amount of free trading stock for One Million Five Hundred Thousand Dollars ($1,500,000.00), to be paid within seven (7) days of receipt of stock. The stock was delivered to Stanton but Stanton never paid the $1,500,000.00.

Kelmer Smith, Jr., a former employee of USSE-NV, who, along with Stanton, took blue prints, plans and other information, the property of Rivera and USSE-NV, and disbursed the same to other companies in breach of the non-disclosure and non-compete agreements which they had signed. The dispensing of such information has caused the Plaintiff damages.
5.
Kelmer Smith, Jr., and John Stanton have contacted business associates and companies which the Plaintiff was in negotiation with and caused those relationships to cease and fail, thereby causing damages to the Plaintiff.
WHEREFORE, PREMISES CONSIDERED, the Plaintiff requests a judgment against the Defendants for tortuous interference with business contracts, unauthorized disclosure of material which was entrusted to their care and bound not to disclose and breach of contracts and covenant to purchase stock, in an amount of Two Hundred Million Dollars ($200,000,000.00).

Why out of Missisippi? This still looks like a wonderful product that the country surely needs, what with all the middle east problems coming. Not lost faith but shaken faith.
